ADVERTISING AGREEMENT NearMe.tel Neighborhood Postcard Mailer Thanks for being part of the mailer! Here is what we both agree to. 1. Parties Publisher: NearMe.tel ("us"), operated by Pretorius Projects. Contact: [email protected]. Advertiser ("you"): Business, contact, email, and phone: as entered in the form below Date: the date you complete checkout 2. What You Get • One ad slot on an 11" × 8.5" neighborhood postcard mailed via USPS Every Door Direct Mail (EDDM) to approximately 5,000 homes in the Menifee/Winchester, CA area (exact count varies by carrier route) • Ad panel size and price as shown for the tier you select at checkout (dimensions listed on the order page) • Up to 3 rounds of ad design revisions at no extra charge • A free business listing on NearMe.tel • A free video feature on Viideo.net (normally $25/month) Your ad will appear on one panel of the mailer. We assign the specific slot and will make reasonable efforts to give you fair, visible placement. A horizontal strip through the middle of each side (12.9 mm) is reserved for NearMe.tel community branding. 3. Design and Approval Send us your logo, photos, business name, phone, website, and any offer or tagline in high-resolution form. We'll design your ad and send you a draft. You get 3 revision rounds included — send all your feedback in one go each time. Once you approve the final design we'll lock it in. If we send a design and don't hear back within 3 business days, we'll treat it as approved so the mailer stays on schedule. 4. Timeline This mailer has 16 ad slots. We print and mail only after every slot is sold. Once the mailer is full, we'll email you the scheduled print date so you have time to approve your final design or cancel under our refund policy. We're targeting a mailing around August 31, 2026, but the actual date depends on when the mailer fills up, plus normal printing and postage timelines. The mailing may also shift because of printing schedules, USPS delays, or other factors outside our control. 5. Payment Your slot is priced as shown for the panel size you select, paid in full when you complete checkout. We accept credit and debit cards via Stripe. Your spot is confirmed once payment clears. 6. Cancellations and Refunds Need to cancel? More than 7 days before the print date we notify you of, you get a full refund. Within 7 days of that date or after printing starts, we're not able to refund since production is underway and we need that time to fill the slot with another business. If we ever have to cancel on our end, you get a full refund within 7 business days. If you don't provide materials, don't approve your design in time, or otherwise hold up production, we may remove your slot; fees may be non-refundable once design work has begun. 7. Your Responsibilities You are responsible for the accuracy and legality of everything in your ad — images, logos, claims, offers, and text. You represent that you own or have permission to use all content you provide, and that your ad complies with applicable laws (including truth-in-advertising and any rules for your industry). You are solely responsible for the claims and offers in your ad. 8. Our Responsibilities We oversee ad design (unless you supply print-ready art), printing, and EDDM mailing. We use professional printing, but small differences in color, alignment, or trim are normal and are not grounds for a refund. We'll keep you informed about your design draft, the print date once the mailer is full, and when your listing and video go live. 9. Delivery and Results We can't guarantee a specific number of calls, customers, or sales — that's the nature of advertising. We are not responsible for undeliverable addresses, incomplete routes, or changes to mailing data by USPS or other carriers. The household count is an estimate. What we can promise is that your ad reaches every home on the selected EDDM routes and your business shows up on NearMe.tel and Viideo.net. Your listing on NearMe.tel and video on Viideo.net go live around the time the postcard mails. We'll let you know when they're up. 10. Liability If something goes wrong on our end, our liability is limited to the amount you paid for your ad slot. You agree to defend and hold us harmless from any claims, costs, or damages that come from your ad content, your offers or claims, or your use of images and logos you provide. 11. General Terms This agreement and your electronic acceptance record are the full deal between us and replace any earlier emails or verbal promises about this mailer. Changes need to be in writing and agreed by both parties. If any part of this agreement can't be enforced, the rest still applies. This agreement is governed by California law (Riverside County courts). Checking the agreement box and completing payment constitutes your electronic acceptance of these terms.
